Passing Off
Passing Off is a tortious economic wrong that consists in the misrepresentation by one business entity to another consumer or trader, through the use of goodwill or get-up closely associated with a rival, that the former’s goods or services originate from or are affiliated with the latter, thereby causing damage to the claimant’s proprietary interest in their reputation.
