Classical Passing Off is a tortious misrepresentation in the law of unfair competition, wherein a trader wrongfully represents their goods or services as those of another to deceive consumers and appropriate goodwill, thereby distinguishing it from other forms of intellectual property infringement by its reliance on reputation and customer confusion in the absence of registered rights.
