Communication Of Intention

Communication of Intention is the legal requirement in the formation of a secret trust whereby the testator explicitly conveys to the intended trustee the duty to hold property on trust and the terms of that obligation, distinguishing it from mere testamentary disposition by establishing a binding inter vivos understanding prior to the execution of the will.
