Comparative Advertising Exception

The "Comparative Advertising Exception" is a legal doctrine within trademark law that permits the use of a registered trademark in advertising to directly compare products or services, provided such use does not cause consumer confusion, mislead, or unfairly benefit from the goodwill of the trademarked brand, thereby distinguishing it from impermissible forms of trademark dilution.
