Objective Recklessness

Objective Recklessness is a legal standard in patent law that qualifies as a form of culpable conduct distinct from subjective intent, wherein the infringer’s actions, judged against an objective reasonableness threshold, demonstrate such indifference to the patent holder’s rights that enhanced damages may be warranted despite the absence of proven willful infringement.
