License Formation is the legal process by which a contractual agreement for the use of software or digital content is established through the acceptance of predefined terms, typically in a shrinkwrap or clickwrap format, thereby distinguishing it from traditional negotiated contracts by its standardized, non-exclusive, and often implied consensual mechanism.
