Deemer Clause

The "Deemer Clause" is a statutory provision within the Employee Retirement Income Security Act of 1974 that constitutes an exception to federal preemption by allowing state insurance regulation to apply to employee benefit plans solely for the purpose of regulating insurance, while otherwise preserving ERISA’s broad preemption of state laws.
