Creditor Misconduct

Creditor Misconduct is a legal doctrine within bankruptcy and insolvency law that refers to inequitable behavior by a creditor, such as fraud, breach of fiduciary duty, or improper manipulation of the debtor, which distinguishes it from ordinary credit transactions and justifies the subordination of the creditor's claim in equitable distribution.
