Capacity Cases

Capacity Cases is a theoretical framework within the academic study of conflict of laws that distinguishes, in cases involving renvoi, between those where a party's legal capacity is governed by the law of the domicile (capacity-as-status) and those where it is governed by the law applicable to the transaction (capacity-as-consent), thereby determining the appropriate choice-of-law analysis.
