Transfer Defects
Transfer Defects is a legal and operational risk arising in loan documentation and liability contexts wherein the imperfections or irregularities in the assignment or endorsement of a loan obligation result in the transferor’s failure to convey valid title or enforceable rights to the transferee, thereby undermining the enforceability or priority of the creditor's claim.
