Remedial Overbreadth

Remedial Overbreadth is a judicial doctrine in constitutional law whereby a court invalidates a statute or regulation not only to the extent of its immediate constitutional violation but also when its remedial application extends beyond the precise injury, thereby preventing future enforcement in a broader range of cases than strictly necessary to address the underlying constitutional defect.
