Quistclose Trusts

A Quistclose Trust is a resulting trust that arises when money is paid for a specific purpose, such that if that purpose fails, the recipient holds the funds on trust for the transferor, distinguishing it from other resulting trusts by its dual-limb structure rooted in the donor’s intention and purposive failure.
