Passing-on Presumption

Passing-On Presumption is a legal doctrine in antitrust and competition law that presumes indirect purchasers have suffered no actionable harm because overcharged direct purchasers passed on the price elevation to subsequent buyers, thereby preventing recovery under the rationale that damages were not absorbed but transmitted further down the supply chain.
