Implied Servitudes

Implied Servitudes is a type of servitude in property law that, rather than being expressly created by deed or other formal grant, is inferred by operation of law from the terms and circumstances of a disposition, prior use, necessity, or statutory context as embodying the presumed intention to burden one parcel of land (or an estate) for the benefit of another.
