Equitable Indemnity

Equitable Indemnity is a legal doctrine within the domain of tort law that, under the principle of comparative fault, permits a court to shift the financial burden of liability from a partially at-fault defendant to another party whose fault is deemed proportionally greater, based on principles of fairness and justice rather than contractual obligation.
