Ebay Test

The "Ebay Test" is a four-part legal standard within trademark and intellectual property jurisprudence—derived from the U.S. Supreme Court’s decision in eBay Inc. v. MercExchange, LLC—that determines whether a permanent injunction should be granted in cases of intellectual property infringement by requiring a plaintiff to demonstrate irreparable harm, inadequacy of legal remedies, a balance of hardships favoring relief, and that the public interest would not be disserved by an injunction.
