Alternative Determinations

Alternative Determinations is a judicial doctrine within the broader category of issue preclusion that distinguishes itself by barring the relitigation of an issue that was necessarily decided on alternative grounds in a prior action, where the judgment rested on more than one independent basis, thus allowing the preclusive effect to apply even if one of the alternative grounds is later invalidated.
