Agency-based Lender Liability

Agency-Based Lender Liability is a legal doctrine within the broader framework of Lender Control Liability that holds a lender liable for the actions or omissions of a borrower when the lender has assumed de facto control over the borrower’s operations, thereby creating an agency relationship whereby the lender is deemed to have directed the conduct leading to the harm.
